Sometime in 2024, Richard Samuel got a marketing job with one of the top telecommunication companies in Nigeria. On his way from Kano (his residence) to Port Harcourt (his place of work), the vehicle he boarded made a quick stop somewhere in Niger State and Richard decided to utilize that opportunity to withdraw some cash at a nearby POS stand. When he got to the stand, the vendor was absent, so he left to buy snacks to fill his hungry stomach for the rest of the journey. While he was leaving, the vendor came back and informed him that he was short of cash at the moment.
While purchasing the snack at a nearby store, some group of persons’ including the POS vendor rushed towards him and started accusing him of stealing over N100,000 from the stand. They searched him, but they didn’t find anything close to that amount in his possession, as such they resulted in beating him. In the course of the beating, his phone was stolen by one of his accusers. He was taken to a police station where he was detained for days and later charged to Court for theft and trespass. Subsequently, the Court remanded him in Suleja Custodial Centre.
In June 2024, Nile University Clinicians interviewed him during one of their routine visits to the Suleja Custodial Centre as part of their activities under the Reforming Pretrial Detention in Nigeria Project Phase II being implemented by PPDC. His matter was assigned to PPDC’s pro bono lawyers ‘Lawrence Ojo-Gabriel Esq. and Cynthia Chukwu Esq.’
Unfortunately, this marked only the beginning of Richard’s ordeal, as his case became yet another victim of the systemic challenges plaguing Nigeria’s criminal justice system. For Seven (7) consecutive Court adjournments, Richard was not produced in Court by the Correctional Service Officers for his matter to be tried due to the logistics challenges plaguing the Service, which was a flagrant disregard of his constitutional right to a fair trial and to be tried within a reasonable time. On seven separate occasions, the Court convened, and PPDC’s pro bono lawyers were present and prepared to advocate. However, the defendant, Richard, was absent, and the prosecution failed to demonstrate diligence in pursuing his case. As a result, a young man with immense potential was left to languish in pretrial detention, denied the opportunity for a fair trial.
His case came up again the 8th time on 16th January 2025, this time around, it took the personal efforts of PPDC’s pro bono to ensure that Richard is produced in Court. The good-looking Richard has now become a shadow of himself, visibly sick with rashes all over his body. The nominal complainant has neglected the case and the prosecution is also not ready to do justice to the case. PPDC’s pro bono lawyers made an application before the erudite Magistrate citing the provisions of Section 193 of the Administration of Criminal Justice Law (ACJL) of Niger State which provides that ‘’Where a case is called up and the defendant appears voluntarily in obedience to the same summons or is brought before the Court under a warrant and the prosecution is not ready or willing to proceed with his case, the Court may in appropriate circumstances, strike out the charge’’. The Court found the application of the lawyers to be meritorious and ruled in their favour and ordered that the defendant be released from Suleja Custodial Centre.
On 16th January 2025, Richard was discharged and his freedom restored. Since he lost his phone on the day his ordeal began, the lawyers assisted him in contacting his family. Richard has now travelled back to Kano State and has been reunited with his family. However, as a consequence of his detention, his health deteriorated, he lost the job in Port Harcourt and potential earnings for the period he was in detention, and he also experienced the ill effect of underfunding the Nigeria Correctional Service (NCoS).
This is the plight of many Nigerians in pretrial detention, unable to access justice due to the systemic shortcomings of our criminal justice system. Pretrial detainees account for about 70% of the detainee population across our custodial centres. Our Constitution provides that anyone who is alleged to have committed an offence is deemed Innocent until proven guilty by a Court of competent jurisdiction. Regrettably, the reverse is the case in our current realities, person’s alleged to have committed an offence end up in pretrial detention for years, while their trial linger in Courts for protracted periods. In some instances, the pretrial detainee ends up staying longer than they would have If they were tried, convicted and sentenced within a reasonable time.
Supported by the Bureau of International Narcotics and Law Enforcement Affairs, PPDC’s Access to Justice Programs—Reforming Pretrial Detention in Nigeria (RPDN) Project Phase II in Nigeria and the Court Administration and Case Management (CACM) Project are structured to drive sustainable and long-term reforms within Nigeria’s justice system.
Indigent and vulnerable pretrial detainees who ordinarily will be forgotten in the system are being provided with pro bono legal services, the technological support to the Nigerian Correctional Service will also guarantee an effective case management system and with the digitization of the Courts, cases will no longer linger in Court for lengthy periods.

Attachment B: terms and conditions
1. TIME OF DELIVERY: Delivery dates to project sites are indicated in this RFQ. Upon failure by the Vendor to make delivery at the time specified, or any extension therefore, PPDC may cancel the contract with respect to any or all deliveries which have not yet been made, except when such failure is due to unforeseeable causes beyond the control and without the fault or negligence of Vendor, including, but without limitations, an Act of God or of the public enemy, acts of governments, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, but not including delays caused by the Vendor, provided that the Vendor, within three days of the beginning of such a delay, notify Creative in writing of the cause of such delay. Upon receipt of written notification of a delay from the Vendor, PPDC will prepare a modification to the Purchase Order to be duly signed by both parties.
2. THIRD PARTY PAYMENT: PPDC will issue payment to the entity identified in the Purchase Order. PPDC will not issue any third-party payments. As such, the entity must have a valid bank account.
3. RISK – PRIOR TO DELIVERY: The articles ordered hereby shall remain at Vendor’s risk until delivery to PPDC or the project site designated in this RFQ, and after any notice of rejection of articles, such rejected articles shall be at Vendor’s risk. When final inspection is at place of origin, but delivery by Vendor is at another place, Vendor’s risk shall continue until articles are delivered to their final destination.
4. EXTRA CHARGES: No charges for extras will be paid to Vendor unless such extras have been ordered in writing by PPDC and price stated in such order.
5. INCREASE OR DECREASE: Unless otherwise specified, no variation in the quantities or qualities ordered will be accepted as compliance with this order.
6. CASH IN LIEU OF MATERIAL: Under no circumstances is the Vendor to make cash payments in lieu of materials. Such practice will result in the cancellation of any PPDC financial responsibility pertaining to this award.
7.ANTI-CORRUPTION:
a. Commission payments to PPDC Staff are not to be made or authorized.
b. No gift, gratuity or remuneration of any kind shall be made to any individual or organization with whom PPDC has an official or business relationship, as a result of this agreement.
c. Arrangements are not to be made for undisclosed rebates to either PPDC or any of its employees or agents.
8. CERTIFICATION REGARDING TERRORISM: As part of the proposals submission, Vendor hereby certifies that it has not provided and will not provide material support or resources to any individual or organization that it knows, or has reason to know, is an individual or organization that advocates, plans, sponsors, engages in, or has engaged in an act of terrorism.
9. FINAL INVOICES: Vendor is required to submit the final invoice, appropriately marked as such, under this order not later than ninety (90) calendar days after completion of the work, or any longer period as may be mutually agreed between the parties. Any invoices received after that date will not be paid by PPDC
10. WARRANTY: Vendor shall, as soon as reasonably practicable, repair or replace any items which are or become defective during the period of 12 months from the date of supply where such defects occur under proper usage and are due to faulty design, erroneous use data provided by the or inadequate or faulty materials or workmanship or any other breach of Vendor’s warranties, express or implied. Repairs and replacement parts shall themselves be subject to the forgoing obligations for a period of 12 months from the date of repair or replacement.
11. TAXES: Vendor must pay any taxes defined for these purposes as value-added taxes and custom duties assessed by the host government. It does not include sales tax or
12. employment taxes required by local law which must be separately identified and reported to PPDC through the Vendor’s invoice.
a. The Vendor is liable for payment of all applicable taxes associated with revenues (profit), and other such taxes, fees, or dues for which the Vendor is normally responsible as a result of operating its business.
b. Vendor shall be responsible for providing a tax identification number, along with bank account details, company name, company or corporate registration number, company address, contact number(s).

As part of a critical routine under the Reforming Pretrial Detention in Nigeria (RPDN) Phase II project, PPDC carried out a correctional center audit at the Suleja Custodial Center. This audit was carried out with the support of two of our project partners, the NBA Bwari Branch, and Veritas University Law Clinic Bwari. This monthly exercise is a vital moment to gauge our progress, measure the impact of our interventions, and reaffirm our commitment to bringing justice to those who need it most.
The goal is simple but profound, to decongest the Nigeria Correctional Center by providing free legal representation for those awaiting trial, support the upgrade and deployment of equipment to enhance the Correctional Information Management System CIMS.
We met with officials from various departments, receiving firsthand insights into how our interventions shape the lives of those awaiting pretrial detainees. There was a glimmer of progress, for us one of the most significant moments of this audit. For the first time, the number of convicts outweighed the number of pretrial detainees. It was a sign that the backlog is finally shifting. More inmates now have legal representation, a clear victory for our cause.
We also conducted interviews with pretrial detainees who had no legal representation. One of them was a 17-year-old boy, a child whose life had been caught in a web far too complex for him to navigate alone. His eyes held a quiet sorrow, the kind that comes from being trapped in a place where time seems to stretch endlessly. But there was hope, too. Our partner, the dedicated NBA Bwari branch, pledged to take up his case, offering him the legal support he desperately needed. It was a reminder that our work is far from finished, but we are moving in the right direction.
Walking through the halls of the center, one cannot help but feel the weight of the stories held within its walls. Each detainee represents more than a case number, they are individuals caught in the tide of a system that often overlooks them. Our work here is not just about numbers but about restoring dignity and ensuring that justice is not a privilege reserved for a few.
As we left the Suleja Custodial Center, the weight of our mission felt both heavy and hopeful. We are not just opening doors to legal representation, we are opening doors to a future where justice is within reach for all.
This audit was not just about checking progress but also seeing the human side of a system that too often forgets its humanity. We were reminded that behind every statistic is a story, and behind every case number is a life waiting for justice.

The supply and delivery of designated equipment to support upgrade of CIMS of the Nigerian Correctional Service (refer to annex A technical specification) across 6 states in Nigeria – Adamawa, Kaduna, Lagos, Nasarawa, Plateau state(s) and the FCT.

REQUIREMENTS
All applicants must provide the following.
Company Profile: registered address, with functional telephone numbers, email addresses and point of contact for the company.
An expression of interest on your official letter head indicating capacity to deliver on this assignment, inclusive of your financial proposal for the items to be supplied.
Latest Tax certificate with the tax identification Number.
Copy of your organisation CAC registration certificate/ business name registration with other CAC documents such as form C07 and C02.
Evidence of experience of previous similar jobs (supply and delivery of similar scope and complexity). Only third-party evidence such as contractual documents will be considered, not a list of similar jobs/references.
Verifiable details of physical contact address, mobile phone numbers and email address(es) must be indicated in your expression of interest.

NOTE THE INFORMATION BELOW:
Appropriate taxes such as Withholding Tax (WHT) will be deducted prior to making any payments for the good[s] supplied in compliance with Nigerian Tax Laws.
All goods delivered as part of this procurement are zero rated, PPDC as an NGO is exempt from the payment of VAT.
Warranty period for all equipment supplied must not be less than One year.
ALL BIDS MUST BE SUBMITTED IN HARD COPY IN A SEALED ENVELOPE
The technical submissions must be separated from the financial bid and each must be signed by an authorised representative; labelled with the company name on one side of the envelope and its content indicated on the other side. (envelop 1 – Technical bid – envelop 2 – Financial bid) The two envelopes will be put on a larger envelop and addressed as indicated below: – SUPPLY AND DELIVERY OF EQUIPMENT TO SUPPORT CIMS UPGRADE – RPDN PROJECT with the address of the vendor clearly indicated at the back of the envelope.

Ensure you put all bids into the PPDC bid box and complete the bid worksheet at the office reception at the address stated above.
All bids must be submitted before close of business on 15th April 2024.
All financial bids must be in Naira (NGN). NOTE: Partial quotes are not allowed.
All proposals submitted including prices are valid for 90 days from the date of submission. Note in some circumstances PPDC may ask that this period be extended beyond this initial period indicated in this RFQ.
All financial bids must be inclusive of installation and delivery costs and must specify maintenance and standard warranty terms and conditions for the various equipment requested.
Bids to be submitted between the hours of 10.00am and 4:00 pm on Monday or Wednesday only. It is your responsibility to ensure your response reaches the address below before the deadline.
Note, the tender can be awarded to one company or split and awarded between companies. Such a decision is subject to the outcome of the bid process.
Note the selected bidder will be responsible for supply, and delivery to the custodial centre (s) located Adamawa, Kaduna, Lagos, FCT, Plateau and Nasarawa states respectively indicated in the table above.
Payment terms: – 100% within 30 days after inspection, testing and confirmation of conformity to requirements and the satisfactory signoff of completion by the State [s] Managers.
